Article 1 – Scope of Application
These Terms and Conditions of Sale apply, without restriction or reservation, to all sales concluded by ECOMSS, trading as Alorya's Mirrors ('the Seller') with consumers and non-professional buyers ('the Customer(s)'), wishing to purchase the products offered for sale by the Seller ('the Products') on the website aloryamirrors.com.
They set out in particular the conditions for ordering, payment, delivery, and management of any returns of Products ordered by Customers.
These Terms and Conditions of Sale may be supplemented by specific conditions set out on the website prior to any transaction with the Customer.
These Terms and Conditions of Sale apply to the exclusion of all other conditions, including those applicable to sales in physical stores or through other distribution channels.
They are accessible at all times on the website aloryamirrors.com and shall prevail, where applicable, over any other version or contradictory document.
These Terms and Conditions of Sale may be subject to subsequent modifications; the version applicable to the Customer's purchase is the one in force on the website at the date the order is placed.
Article 2 – Products Offered for Sale
The Products offered for sale on the website aloryamirrors.com are as follows:

The main characteristics of the Products, including specifications, illustrations, and dimensions, are presented on the website aloryamirrors.com. The Customer is required to read these before placing any order. The selection and purchase of a Product is solely the Customer's responsibility.
Photographs and graphics presented on the website aloryamirrors.com are not contractually binding and shall not engage the Seller's liability.
The Customer is required to refer to the description of each Product to understand its properties, essential characteristics, and delivery times.
Contractual information is presented in English and is confirmed no later than at the time the Customer validates their order.
Article 3 – Validity Period of Product Offers
Product offers are valid subject to available stock, as indicated when the order is placed.

In accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, the Customer has, at all times, a right of access, rectification, objection, erasure, and portability of all their personal data by writing, with proof of identity, to the Seller's address indicated above.
Validation of the order by the Customer constitutes acceptance without restriction or reservation of these Terms and Conditions of Sale.
The Customer acknowledges having the legal capacity to contract and purchase the Products offered on the website aloryamirrors.com.
Article 5 – Orders
5.1 Placing an Order
The Customer may select Products they wish to order on the website aloryamirrors.com. The Customer may check the details of their order, the total price, and correct any errors before confirming their acceptance. It is the Customer's responsibility to verify the accuracy of the order and to report or correct any error immediately.
An order is registered on the website aloryamirrors.com when the Customer accepts these Terms and Conditions of Sale by ticking the relevant box and validates their order. This validation implies full acceptance of these Terms and Conditions of Sale as well as the website's general terms of use.
The sale is only finalised upon the Seller sending the Customer an order confirmation by email, which must be sent without delay and after receipt of full payment.
Any order placed and validated by the Customer and confirmed by the Seller, under the conditions described above, on the website aloryamirrors.com constitutes the formation of a distance contract between the Customer and the Seller.
Unless proven otherwise, data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Customer.
The Seller reserves the right to cancel or refuse any order from a Customer with whom a dispute exists regarding payment of a previous order.
The Customer may track their order on the website aloryamirrors.com under the 'Order Tracking' section.
The Seller does not intend to sell Products on the website aloryamirrors.com to professionals, but only to consumers or non-professionals for their personal use. The Seller therefore reserves the right to refuse orders for the same Product in large quantities (more than 5 items per order).
5.2 Modifying an Order
Any modifications to the order by the Customer may only be considered by the Seller within the limits of its capabilities and provided they are notified by email to support@aloryamirrors.com at least 24 hours before the scheduled dispatch date of the order.
If such modifications cannot be accepted by the Seller, any sums already paid by the Customer shall be refunded within a maximum of 14 days from notification of the impossibility of accepting the requested modifications (unless the Customer prefers a credit note or exchange).
5.3 Cancelling an Order
Orders may be cancelled by the Customer outside the exercise of the right of withdrawal or in cases of force majeure at least 24 hours before the scheduled delivery date of the ordered Products, at no cost to the Customer.
Article 6 – Pricing
Products are supplied at the prices in force on the website aloryamirrors.com at the time the order is recorded by the Seller. Prices are expressed in British Pounds Sterling (£), inclusive of all taxes.
Prices take into account any reductions granted by the Seller on the website. These prices are firm and non-revisable during their period of validity, as indicated on the website. The Seller reserves the right to modify prices at any time outside this period of validity.
Prices include processing, dispatch, transport, and delivery charges. The amount requested from the Customer corresponds to the total purchase price, including all such charges.
Article 7 – Payment Terms
The price is payable in full on the day the order is placed by the Customer, by secure payment, using the following methods:

Payment by bank card is irrevocable, except in cases of fraudulent use of the card. In such cases, the Customer may request cancellation of the payment and restitution of the corresponding sums.
Article 8 – Delivery
Products ordered by the Customer will be delivered to the United Kingdom.
The delivery time corresponds to the dispatch time indicated on the Product page, plus processing and transit time. Products are delivered within an average of 8 to 12 business days to the address provided by the Customer when ordering on the website aloryamirrors.com.
Delivery is constituted by the transfer to the Customer of physical possession or control of the Product. Unless otherwise specified or a Product is unavailable, ordered Products will be delivered in a single consignment.
The Seller undertakes to use its best efforts to deliver Products within the above-mentioned timeframes. However, these timeframes are provided for indicative purposes only. If Products have not been delivered within 30 days of the indicative delivery date, for any reason other than force majeure or the Customer's own actions, the sale may be cancelled at the Customer's written request, in accordance with applicable consumer protection legislation. Any sums paid by the Customer shall then be refunded within fourteen days of cancellation, with no additional compensation or deductions.
In the event of non-conformity of the delivered Product, the Seller undertakes to remedy the situation or refund the Customer, as set out in the 'Seller's Liability – Guarantee' article.
The Seller bears the risks of transport and is liable to refund the Customer for any damage caused during transit.
Article 9 – Transfer of Ownership – Transfer of Risk
Transfer of ownership of the Products from the Seller to the Customer shall only occur upon receipt of full payment by the Seller, regardless of the delivery date of said Products.
Regardless of the date of transfer of ownership, the transfer of the risks of loss and deterioration shall only occur when the Customer takes physical possession of the Products. Products therefore travel at the Seller's risk.
Article 10 – Right of Withdrawal
In accordance with applicable legal provisions, the Customer has a period of fourteen (14) days from receipt of the Product to exercise their right of withdrawal from the Seller, without giving reasons or paying any penalty, for the purpose of exchange or refund, provided that the Products are returned in their original packaging and in perfect condition within fourteen (14) days following notification to the Seller of the decision to withdraw.
Returns must be made in their original condition and complete (packaging, accessories, instructions, etc.), allowing them to be resold as new, accompanied by the purchase invoice. Damaged, soiled, or incomplete Products will not be accepted for return.
The right of withdrawal may be exercised online using the withdrawal form available on the website aloryamirrors.com, upon which a durable acknowledgement of receipt will be immediately communicated to the Customer by the Seller, or by any other unambiguous statement expressing the wish to withdraw.
Upon exercise of the right of withdrawal within the above-mentioned period, only the price of the Product(s) purchased and the original delivery charges are refunded; the cost of return postage remains the Customer's responsibility.
The refund will be made within fourteen (14) days of the Seller's receipt of the Customer's withdrawal notification.
Article 11 – Seller's Liability – Guarantee
Products sold on the website aloryamirrors.com comply with applicable UK regulations and have performance characteristics compatible with non-professional use.
Products supplied by the Seller benefit, by right and without additional payment, independently of the right of withdrawal, in accordance with legal provisions, from:

The statutory guarantee of conformity, for Products that are apparently defective, damaged, or do not correspond to the order

The statutory guarantee against hidden defects arising from a defect in material, design, or manufacture affecting the delivered Products and rendering them unfit for use
Under the statutory guarantee of conformity, the Customer has two (2) years from delivery of the goods to take action against the Seller; may choose between repair or replacement of the ordered Product, subject to cost conditions provided for under applicable legislation; and is not required to prove the existence of a conformity defect in the Product during the twenty-four months following delivery.
The statutory guarantee of conformity applies independently of any commercial guarantee that may cover the Product. The Customer may also invoke the guarantee against hidden defects in accordance with applicable law; in which case, they may choose between cancellation of the sale or a reduction in the sale price.
The Seller will refund or replace Products or parts under guarantee found to be non-conforming or defective. Dispatch costs will be refunded on the basis of the invoiced rate and return costs will be refunded upon presentation of supporting documents.
Refunds for Products found to be non-conforming or defective will be made as quickly as possible and no later than 14 days following the Seller's identification of the non-conformity or hidden defect. The refund will be made by credit to the Customer's bank account.
The Seller's liability shall not be engaged in the following cases:

Non-compliance with the legislation of the country in which the Products are delivered, which is the Customer's responsibility to verify

Misuse, use for professional purposes, negligence, or lack of maintenance by the Customer, as well as normal wear and tear of the Product, accident, or force majeure
The Seller's guarantee is, in all cases, limited to the replacement or refund of non-conforming Products or Products affected by a defect.
Article 12 – Personal Data Protection
In accordance with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018, it is noted that personal data requested from the Customer is necessary for processing their order and issuing invoices, in particular. This data may be communicated to the Seller's partners responsible for the execution, processing, management, and payment of orders.
The processing of information communicated via the website aloryamirrors.com meets the legal requirements relating to personal data protection, with the information system used ensuring optimal protection of such data.
The Customer has, in accordance with applicable national and UK regulations, a permanent right of access, modification, rectification, objection, portability, and restriction of processing regarding information concerning them. This right may be exercised under the conditions and according to the procedures defined on the website aloryamirrors.com, or by contacting support@aloryamirrors.com.
To exercise these rights or to lodge a complaint, the Customer may also contact the Information Commissioner's Office (ICO) at: https://ico.org.uk/make-a-complaint/
Article 13 – Intellectual Property
The content of the website aloryamirrors.com is the property of the Seller and its partners and is protected by UK and international intellectual property law. Any total or partial reproduction of this content is strictly prohibited and may constitute an act of infringement, passing off, or unfair competition.
Article 14 – Unforeseen Circumstances
These Terms and Conditions of Sale expressly exclude any implied terms regarding relief from performance in circumstances of hardship or fundamental change. Both the Seller and the Customer therefore waive any right to invoke such relief in connection with the sale of Products under these Terms and Conditions.
Article 15 – Force Majeure
Neither party shall be held liable if the non-performance or delay in performance of any of their obligations as described herein results from a case of force majeure, as defined under applicable law, including but not limited to natural disasters, strikes, pandemics, government restrictions, or supply chain disruptions beyond the Seller's reasonable control.
Article 16 – Applicable Law – Language
These Terms and Conditions of Sale and the transactions arising therefrom are governed by English law for Customers resident in the United Kingdom, and by French law for all other matters. They are drawn up in English.
For Customers resident in the United Kingdom, nothing in these Terms and Conditions affects your statutory rights under the Consumer Rights Act 2015 or any other applicable UK consumer protection legislation.
Article 17 – Disputes
In the event of a dispute, the Customer is encouraged to contact the Seller's customer service team in the first instance at support@aloryamirrors.com to seek an amicable resolution.
If no amicable resolution can be found, the Customer may have recourse to an alternative dispute resolution (ADR) scheme. For UK Customers, the following options are available:

Any disputes that cannot be resolved by the above means shall be submitted to the competent courts under the applicable law. UK Customers may also bring proceedings before the courts of England and Wales.
Article 18 – Pre-contractual Information – Customer Acceptance
These Terms and any separate agreements whereby we provide you with Services shall be governed by English law for Customers resident in the United Kingdom, and by French law for all other matters. For Customers resident in the United Kingdom, nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or any other applicable UK consumer protection legislation.
Annex 1 – Statutory Guarantee Provisions
The following provisions reflect the applicable statutory guarantees under UK consumer law, in particular the Consumer Rights Act 2015:
Conformity: The Seller is required to deliver goods that conform to the contract. Goods must be of satisfactory quality, fit for purpose, and as described.
Short-term right to reject: The Customer has 30 days from delivery to reject goods that do not conform to the contract and receive a full refund.
Repair or replacement: After the 30-day period, the Customer may request repair or replacement of non-conforming goods. If repair or replacement is not possible or not carried out within a reasonable time, the Customer may claim a price reduction or final right to reject.
Guarantee period: The Customer benefits from a statutory guarantee period of six years from delivery (five years in Scotland) to bring a claim for non-conforming goods.
Burden of proof: During the first six months following delivery, it is presumed that any defect existed at the time of delivery. After six months, the Customer must demonstrate that the defect existed at the time of delivery.
Hidden defects: The Seller is liable for hidden defects in the goods that render them unfit for their intended purpose, or which reduce their utility to such a degree that the Customer would not have purchased them, or would have paid a lower price, had they been aware of such defects.
Annex 2 – Withdrawal Form
This form must be completed and returned only if the Customer wishes to withdraw from the order placed on aloryamirrors.com, subject to the exclusions or limitations on the right of withdrawal set out in the applicable Terms and Conditions of Sale.
